The Tenant authorizes the Landlord to set-off all amounts due and payable pursuant to this Agreement including Rent, any service charges and any other amount for which the Tenant may be liable pursuant to this Agreement. The Tenant waives any right lo set-off with respect to any amounts owed to the Tenant by the Landlord under this Agreement;
1.2. pay the Security Deposit on or before the Date of Execution of this Agreement, which will be interest free, and the Landlord will refund the same to the Tenant on termination or expiry of the Agreement by either party after adjusting for any rent, charges or dues that are recoverable from the Tenant;
1.3. ensure all payments are received by the Managing Agent and that the Rent. Security Deposit and agency fee have cleared in the Managing Agent's account prior to the Commencement Date. The Tenant hereby acknowledges and agrees that occupation of the Unit(s) will not be granted unless this clause Is satisfied.
1.4. in the event that any payment is returned unpaid for any reason. provide replacement payments to the Managing Agent prior to the Commencement Date and within forty eight (48) hours of the due date in addition to a penalty charge of 5% of the payment due and an administration fee of AED500I- in cash or a manager's cheque. The application of the penalty charge and administration fee shall not prevent the Managing Agent and! or Landlord from exercising rights and remedies under law. The Tenant shall assume full liability in the event that third party payments are provided.
1.5. neither sub-tease, nor share in whole or In part, nor use the Units(s) for any purpose other than as a private residential dwelling for the sole, private, non-commercial use of the Tenant and his/ her immediate family and occasional personal visitors unless otherwise agreed to in writing by the Landlord or Managing Agent. In case the Tenant Is a company, only their employees and their employee's immedlately family members shall occupy the unit for purposes mentioned above.
1.6. not change the locks. The loss of any or all keys, security passes and remotes shall be reported to security staff immediately and to
the Managing Agent in writing. The charges of replacement of locks. security passes and remotes will be borne by the Tenant.
1.7. not create a nuisance to the Landlord, Managing Agent or any occupants in neighboring unit(s). This includes but is not limited to any illegal act or acts which may violate the terms of any insurance policy in relation to the Units(s):
1.8. not hang laundry and other items from the balconies. Low level laundry racks which are provided may be permitted depending on the developer. community, home owner's association and/ or strata declaration. II is the Tenant's responsibility to familiarize themselves with these regulations.
1.9. not store any goods In the corridors or in the emergency stairways.
1.10. not accept the delivery of gas bottles to the Unit(s) in the event that Municipality, developer, community, home owner's association and/ or strata declaration direct that gas bottles are not permitted. Access to such suppliers will be rejected by the security staff and/ or Managing Agent.
1,11. not keep any pets except with the written permission of the Landlord and! or Managing Agent and subject to the developer, community, home owner's association and! or strata declaration. In the event that written permission has been provided and recurring complaints are received from other occupants in neighboring unit(s), this permission shall be withdrawn and the Tenant shall remove any pets from the Unit(s) within three (3) days.
1.12. not contact the Landlord directly. All communications are to be via the Managing Agent.
1.13. raise all maintenance requests through the Managing Agent's call centre number provided above, unless otherwise instructed in writing. Maintenance requests made by any other means such as directly to the property supervisor, maintenance provider, the Landlord or any on site staff shall not be treated as valid.
1.14. not request for alternative accommodation or for the cost of same to be provided by the Landlord and/ or Managing Agent either during or after the completion of any maintenance.
1.15, be present during maintenance. Maintenance is provided by third party contractors. The Managing Agent and Landlord are not liable for the supervision of third party contractors during any maintenance or for any other reason. Neither the Managing Agent nor the Landlord are liable for any matter including but not limited to any alleged damage. loss, breakage or theft caused in the course of maintenance works being completed. In the event that a pre arranged appointment for maintenance Is subsequently refused by the Tenant, a cancellation fee of AED300/• will be payable by the Tenant. Abuse of maintenance providers will not be tolerated under any circumstances.
