Start chapter 4Dual loyalties 1.18Obligation to reportThe World Medical Association recommends that the national medical associations include in their ethical rules an obligation on doctors to report or denounce acts of torture or cruel, inhuman or degrading treatment of which they are aware (The World Medical Association resolution on the responsibility of doctors in the denunciation of acts of torture or cruel or inhuman or degrading treatment of which they are aware, adopted September 2003).The doctor cannot disclose such information without informed consent from the patient. There may even be cases of the prisoners wanting such information to be made public. In all circumstances, the doctor should handle such information with care. Even if the prisoner wants the doctor to 'testify' so-to-say, the doctor should not do it without ensuring the prisoner fully realizes what s/he is getting into. Sometimes prisoners have the (false) impression that just because they tell the doctor they are automatically protected. This may not be the case at all, and the doctor should make sure this is clearly understood. In many countries, reporting of abuses can make the situation for the prisoner worse due to reprisals. The doctor must not put the safety of the witnesses or victims at risk, but if it is not dangerous, the doctor should try to record accurate evidence in order to document abuse later on, or when the situation allows it. Information about human rights violations could also be handed over to non-governmental organisations such as Amnesty International, Physicians for Human Rights, the World Medical Association, the International Committee of the Red Cross and other such agencies.
