على الرغم من وفاء المدعي بالتزاماتها وتسويتها لمبلغ المديونية المترتب على ذمتها وفقا لما هو مذكور فى مستند الادعاء رقم (12) ، وحيث انه كان من المفترض على المدعي عليه اعادة الضمانات المقدمة من المدعية ضمانا لسداد المديونية بعد تسويتها ،
فقد امتنعت المدعى عليها عن رفع الرهونات عن معدات الشركة المدعي ولم تقم باعادة الشيكات ، رغم قبضها كامل مستحقاتها من المدعي وفقا لما هو صادر عنها بحساب دفةر الاستاذ . ووفقا لاقرارها بأن ذمة المدعي قد برئت تجاهها من خلال الرسالة الموجهة منها بتاريخ 23/2/2015 الى شركة تأجير للتمويل
حيث جاء بهذه الرسالة نصا
(بالاشارة الى المتأخرات العالقة في حساب شركة تأجير للتجارة يسعدنا افادتكم بأن شركة الرصيد قد قاموا بسداد مبلغ وقدره 292,000 الف ريال (مائتان واثنان وتسعون الف ريال عماني) وان بعض حساباتهم قد اغلقت نهائيا بعد سدادهم لكامل المديونية وليست هناك اي متأخرات مع التزامهم بتسديد بقية التزاماتهم حسب ميعادها)
وبذلك تكون المدعى عليه قد اخلت بالتزامها العقدي والقانوني الناشئ عن عقد التمويل . (مستند ادعاء رقم (14) صورة ضوئية من رسالة المدعى عليها لشركة تأجير للتمويل بتاريخ 23/2/2015م) .
