Dear Mr. Abdullah,
Thank you for your apology, we really appreciate it. However, this incident has caused a great damage to our business and relationship with the workers. They are considering the walk out as a strike and its become very difficult for us to regain the discipline and control back in the factory.
It is affecting our permanent employee and jeopardizing our operations. We are stuck in a very bad situation. We simply cannot continue efficiently under the circumstances.
Furthermore, we are facing issues with the late arrival of the contracted NAAS technician. Over the course of the agreement, to date we have not received all the technicians as agreed in the contract. Infact, we were supposed to receive the complete team within 90 days of the downpayment. Unfortunately, we are still receiving new employees on monthly basis. This is not acceptable & disrupts our work schedule.
Our proposal to you is, given that only a few months are left in the expiry of our contract, we would like to return the technicians on monthly basis. We want to honor our commitment and want our relationship to continue, and the current situation needs a resolution that will not affect both parties. We would like to amend our agreement as per following proposal:
We would like to return, without replacement, the technicians on monthly basis. These technicians should be removed from our payroll charge. Please note most of these technicians arrived very late into the contract. Long after the 90 days agreed period.
• For immediate effect (as per effect on December 6, 2015) the following technicians must be removed from our contact with no replacements necessary:
1. E01928 – Nafees Ahmad Khan – Disciplinary reason – refusal to work – has not reported to work since the beginning of the month.
2. E02685 – Suneel Prasad Shiv Prasad – Disciplinary reason – refusal to work
3. E05541 – Muhammad Ibrar Muhmaad Riaz – Delayed Arrival
4. E05618 – Tariq Iqbal Allah Khan – Delayed Arrival
5. Technician no.35 - still not arrived after more than a year and a half since the contract was signed
o (Please note, we want these technicians to leave our housing premises immediately. If you can kindly arrange for their pick-up as soon as possible)
• 5 technicians to be removed by January 09, 2016
• 5 technicians to be removed by February 09, 2016
• 5 technicians to be removed by March 09, 2016
• 5 technicians to be removed by April 09, 2016
• The remaining technicians can be returned at the expiry date of our agreement on July 09, 2016.
We want to cooperate with you and want to ensure there is least inconvenience to both sides. There is only 6 months left on end date and I sure we can agree to phase out this agreement in the interest of both parties in a systematic way.
I want to assure you that the November 2015 invoice will be paid without any changes. We are currently in the process of transferring the amount. October 2015 invoice has already been paid.
I would really appreciate your agreement to the above and the necessary amendment to the agreement. If you want to discuss this further, please set up a face to face meeting at our office within this week.
