We also agree with the judge that, whilst it is true that the rule uses the expression "to enforce", which Mr Edward Cohen suggests presupposes assets within the jurisdiction, CPR Pt 74 is itself headed "Enforcement of judgments in different jurisdictions" in circumstances where, as just stated, registration under Part 74 does not require the existence of assets within the C jurisdiction. Moreover, we accept Mr Cohen QC's submission that enforcement of a judgment naturally includes enforcement by action: see Pritchett v English and Colonial Syndicate [z89~J z QB 42~~ 434 and Godfrey v George (1896] z QB 48, Sz per Lord Esher MR, where he said "this is an order in a civil matter and . . . it may be enforced by action as if it were a judgment".
