Our auditors would not obtain comfort over this valuation and this could potentially lead to audit qualifications. Further, we understand based on our internal study that this would be an expensive and time consuming exercise with the costs outweighing the benefits.
An alternative to the valuation would be to make a slight modification to the lease terms by adding an addendum to the original lease agreement or modifying the original lease agreement. As per clause 3 of the existing lease agreement and as mentioned earlier in this letter, the lease may be renewed for additional period or periods of years upon such terms and conditions as may be agreed to by the parties. We humbly request if this clause could be modified as, the lease may be renewed for additional period or periods of years, at the option of the lessee (NatPet). This modification of term would enable the Company to do away with the tedious exercise of estimating the site restoration
liability, as this would indicate that NatPet has to unilateral option to extend the lease term for
indefinite future periods and estimating the site restoration liability would not be possible, without a definite lease term. Further, the management of the Company sincerely believes that, the Company would in all certainty extend the lease term as long as the Company is in existence. Further, we assure
you that this request to modify the lease terms is purely from an accounting point of view and will not in any sense, change the substance or the legal form of the lease agreement.
Alternatively, the matter could also be resolved under the pretext of significance if the Royal Commission agrees to include literature in the addendum along the line of: in lieu of Natpet's contribution to the Saudi economy and in the interest of the prosperity of the industrial sector, NatPet would not be required to vacate the property and dismantle the plant in the foreseeable future subsequent to the expiry of the lease agreement.
